The professional scope, limitations and responsibilities that apply to Property Decision Support services.

Property Decision Support Malta & Gozo provides independent practical property decision support for private buyers and sellers.

The service helps customers prepare better questions, understand visible property-related issues, organise property information and make clearer decisions.

This page should be read together with the Terms & Conditions, Website Disclaimer, Privacy Policy, Cancellation & Refund Policy and Documentation & Media Consent where applicable.

1. Practical decision support only

The service is practical decision support.

It is based on:

  • practical property experience;
  • visible observations;
  • customer-provided information;
  • available property links, photos, documents or notes;
  • discussion with the customer;
  • the property condition and access available at the time of the service.

The service is intended to support customer understanding, preparation and decision-making.

It is not a regulated professional report, statutory certificate, formal expert opinion, warranty, guarantee or substitute for specialist professional advice.

2. What the service may include

Depending on the package booked, the service may include:

  • practical review of visible property conditions;
  • discussion of obvious or suspected property risks;
  • buyer preparation support;
  • seller preparation support;
  • review of customer-provided property information;
  • review of listing information or property links;
  • preparation of questions for agents, sellers, buyers, notaries, Periti or other professionals;
  • practical notes, action lists, observations or report-style materials;
  • documentation of visible issues or decision-relevant points;
  • practical suggestions for next steps.

The exact service scope, format, price and deliverables are shown on the relevant service page or at checkout.

3. Not estate agency, brokerage or transaction representation

The service is not estate agency work, brokerage, property intermediary work or property transaction representation.

The provider does not:

  • market property for sale as an estate agent;
  • list properties for sale;
  • introduce buyers or sellers;
  • represent buyers or sellers in negotiations;
  • negotiate sale or purchase terms;
  • act as a broker or intermediary;
  • hold client money for a property transaction;
  • prepare or manage transaction documentation as an estate agent;
  • earn commission from a property transaction.

The provider is paid only for the booked Property Decision Support service.

4. No buyer or seller mandate in the transaction

The provider does not become the customer’s legal representative, estate agent, broker, buyer agent, seller agent, transaction manager or negotiator.

The provider may help the customer prepare questions, clarify concerns and understand decision-relevant issues.

However, the customer remains responsible for their own communication, negotiation, transaction decisions and professional appointments.

5. Not formal valuation advice

The service is not a formal valuation.

The provider does not provide a bank valuation, mortgage valuation, insurance valuation, statutory valuation, court valuation or formal market value opinion.

Any discussion of price positioning, asking price, buyer perception, seller expectations, market presentation, negotiation pressure or perceived risk is practical decision support only.

Such discussion is intended to help the customer think more clearly about the property decision and should not be treated as valuation advice.

Customers who require a formal valuation should instruct an appropriately qualified or authorised valuation professional.

7. Not a Perit report, technical survey or structural assessment

The service is not:

  • a Perit report;
  • an architect inspection;
  • an engineering inspection;
  • a structural survey;
  • a building survey;
  • a technical condition report;
  • a building pathology report;
  • a safety certification;
  • a compliance certificate.

The service does not include:

  • destructive testing;
  • invasive inspection;
  • opening of walls, floors, roofs, shafts, finishes or services;
  • removal of fixtures, fittings or coverings;
  • laboratory testing;
  • material testing;
  • structural calculations;
  • engineering design;
  • certification of building safety;
  • certification of structural adequacy;
  • certification of waterproofing, damp proofing or building services;
  • confirmation that works comply with all technical standards or regulations.

Structural, engineering, architectural, building-condition, waterproofing, damp, drainage, services or safety concerns should be referred to a Perit, architect, engineer, warranted surveyor, specialist contractor or other appropriate professional.

8. Visible and accessible areas only

The service is limited to visible and reasonably accessible areas and information available at the time of the service.

The provider does not guarantee that inaccessible, concealed, covered, hidden or latent issues will be identified.

Examples of areas or issues that may not be fully assessed include:

  • hidden damp behind finishes;
  • concealed leaks;
  • hidden structural movement;
  • hidden corrosion;
  • concealed drainage defects;
  • hidden roof or waterproofing failures;
  • covered masonry or concrete defects;
  • concealed electrical or plumbing problems;
  • inaccessible shafts, roofs, voids or service spaces;
  • issues behind furniture, finishes, appliances or stored items.

Where an issue cannot be properly assessed within the service scope, the provider may recommend further specialist review.

9. Moisture, damp and building condition observations

The provider may discuss visible or suspected damp, moisture, ventilation, condensation, mould, cracking, drainage, waterproofing or maintenance issues where relevant to the booked service.

Such observations are practical decision-support observations only.

They are not a full damp survey, waterproofing assessment, mould assessment, structural diagnosis, laboratory analysis or guarantee of cause.

Moisture-related issues can have multiple causes and may require specialist testing, monitoring, opening-up, contractor review, Perit input or laboratory analysis.

The provider may identify visible indicators, practical concerns or follow-up questions, but does not guarantee that all moisture-related defects or causes will be identified.

10. Customer-provided information

The service may rely on information supplied by the customer, such as:

  • property links;
  • listing descriptions;
  • photos or videos;
  • documents;
  • seller or agent statements;
  • customer concerns;
  • previous reports;
  • invoices or contractor information;
  • access details;
  • known issues.

The customer is responsible for providing accurate, complete and lawful information.

The provider may rely on customer-provided information without independently verifying its legal status, authenticity, completeness or accuracy, unless the booked service expressly states otherwise.

Incomplete, inaccurate or late information may affect the quality, timing or usefulness of the service.

11. No guarantee that all issues will be identified

The provider cannot guarantee that all defects, risks, hidden issues, planning problems, legal defects, title issues, structural problems, damp problems, services issues, maintenance problems, future objections or buyer concerns will be identified.

The service is limited by:

  • the agreed package;
  • available time;
  • available access;
  • visible conditions;
  • customer-provided information;
  • documentation provided;
  • weather and site conditions;
  • safety and practicality;
  • the non-invasive nature of the service.

The absence of a comment on an issue does not mean that the issue does not exist.

12. No guaranteed transaction result

The service does not guarantee:

  • a sale;
  • a purchase;
  • a faster transaction;
  • a better sale price;
  • a lower purchase price;
  • buyer interest;
  • seller agreement;
  • agent behaviour;
  • negotiation success;
  • financing approval;
  • insurance approval;
  • notarial approval;
  • legal approval;
  • planning approval;
  • any particular decision by a third party.

The service is intended to improve clarity, preparation and decision-making.

The customer remains responsible for their own decisions and transaction choices.

13. Service materials and reports

Depending on the booked package, the provider may prepare notes, action lists, observations, report-style materials or other written outputs.

These materials are prepared for practical property decision support.

They are not intended to be used as:

  • a formal valuation;
  • a Perit report;
  • a structural survey;
  • a legal opinion;
  • a title report;
  • a planning confirmation;
  • a bank report;
  • an insurance report;
  • a warranty;
  • a guarantee of property condition.

Service materials should be read in the context of the agreed service scope, available information and limitations stated on this page and in the Terms & Conditions.

14. Use by the customer

The customer may use service materials for their own property decision-support purposes.

The customer may share the materials with their own lawyer, notary, Perit, architect, engineer, estate agent, lender, family members or professional advisers where reasonably necessary for the relevant property decision.

The customer must not edit, misrepresent, publish or use the materials out of context.

The customer must not present service materials as a formal valuation, Perit report, structural survey, legal opinion, title report, planning confirmation, bank report, insurance report or warranty.

15. Referrals and follow-up recommendations

The provider may suggest that the customer asks further questions or obtains advice from another professional.

This may include a notary, lawyer, Perit, architect, engineer, warranted surveyor, valuer, specialist contractor, tax adviser, lender, financial adviser, insurance adviser or licensed real estate professional.

Such suggestions do not create a referral relationship, partnership, agency relationship or guarantee regarding the work of any third party.

The customer is responsible for choosing, instructing and relying on any third-party professional.

16. Independence and conflicts

The provider aims to provide independent property decision support.

The provider does not knowingly support both sides of the same property transaction.

If the provider has already supported one side of a specific property matter, the provider may refuse to support the other side on that same matter.

The provider does not accept estate agent commissions, buyer referral fees, seller referral fees or transaction success fees in connection with the customer’s property transaction, unless this is clearly disclosed and lawfully agreed in advance.

The standard service is designed to be paid directly by the customer for independent decision support.

17. No duty to monitor after the service

Unless expressly agreed in writing, the provider has no ongoing duty to monitor the property, market, transaction, legal status, planning position, physical condition, agent communication or third-party actions after the service has been delivered.

Any later change in property condition, market conditions, documentation, negotiation position, seller behaviour, buyer behaviour, legal status, planning status or third-party information may affect the customer’s decision.

Customers should seek updated advice where circumstances change.

18. Customer responsibility

The customer remains responsible for:

  • deciding whether to buy, sell, proceed, pause or withdraw;
  • instructing appropriate professionals;
  • verifying legal, title, planning, financing, insurance and tax matters;
  • arranging specialist inspections where required;reviewing contracts and notarial documentation;
  • considering risks, costs and personal circumstances;
  • making the final decision.

The service supports decision-making but does not replace the customer’s own judgement or specialist professional advice.

20. Changes and specific service terms

The scope of a specific booked service may be further defined by the relevant service page, checkout summary, confirmation email or written agreement.

If a specific service page or checkout summary provides a narrower or more specific scope, that specific scope applies to the booked service.

This Professional Scope may be updated from time to time.
